(collectively, “Company,” “we,” “our,” or “us”) respect your privacy and are committed to protecting it through compliance with this Privacy Policy, which applies to Personal Data (as defined below) collected through our websites (Member Connection, Dentist Connection, Employer Connection, Broker Connection, and our Public Website), including parts of the websites that require authentication through a unique login to access (“Secure Online Account”), that link to this Privacy Policy, and all digital assets contained or offered therein (“Websites”), our mobile messaging program (“Messaging Program”), and through any online activities (collectively, our “Services”), except as described below. This Privacy Policy describes, among other things, the types of Personal Data we collect from users when you use our Services; how we collect, process, retain, use, and disclose your Personal Data; and how you can access it.
Under the Health Insurance Portability and Accountability Act (HIPAA) and the Health Information Technology for Economic and Clinical Health Act (HITECH), we are also required to safeguard Protected Health Information. We handle such Protected Health Information in accordance with our Notice of Privacy Practices, which governs its use, disclosure, and protection.
This Privacy Policy does not apply to:
- Protected Health Information governed under our separate Notice of Privacy Practices.

A. Personal Data You Provide to Us
In using our Services, you may provide us with your Personal Data, including when you contact us with questions or requests, create an account or register to use the Secure Online Account, complete forms, subscribe to receive updates, or otherwise use the interactive features on our Websites.

- Authentication data such as account personal information and log in credentials, including unique identifiers such as username or account number combined with passwords or other security codes.
- Payment information including debit or credit card information in combination with any required security or access code collected for purpose of processing payment for our products or Services.
- Social Security number.
- Racial or ethnic origin information.
- Characteristics of protected classifications under applicable law, including state or federal law. This may include age, veteran status, information related to accommodations, sex, and religion.
When required by applicable law, Company will collect consent prior to processing certain categories of Sensitive Data.

We may also use reCAPTCHA, a tool which utilizes advanced risk analysis techniques to distinguish humans and bots in order to help us protect our websites from fraud, spam, and abuse. - Mobile Application Technologies. If you access our Services through the Delta Dental mobile application (the “Mobile App”), refer to Delta Dental Plan Association’s Privacy Statement here: Privacy Statement for the Delta Dental Plans Association Website and Mobile App, regarding how information about your device, your phone number, and your physical location may be automatically collected.
Our use of online tracking technologies may be considered a “sale” or “sharing” under certain laws. To the extent that disclosing information to these online tracking technologies is deemed to be a “sale” or “sharing” under certain laws, you can opt out of these online tracking technologies by broadcasting an opt-out preference signal, such as the Global Privacy Control (GPC). You may be able to enable GPC settings within the browser that you use to access our Site; however, please note that this opt out is specific to the device and browser used when submitting the opt out. II. How We Use Your Personal Data
A. Use and Purpose of Processing Your Personal Data
We use and process information that we collect about you or that you provide to us, including Personal Data, to:
- Provide you with our Services and any contents, features, information, products, or services that we make available through our Services.
- Verify that each user/registrant is unique and provides us with the necessary information to respond to inquiries and questions and provide customer service.
- Determine your eligibility for certain offers, products, or services that may interest you and notify you about these opportunities.

We may share Personal Data with designated Company employees and authorized personnel, including contractors, who need access to limited information to perform their job responsibilities and support our business operations. This includes, but is not limited to, exchanging information with other companies and organizations for the purposes of fraud protection.
- Business Transfers. We may disclose Personal Data to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Company is among the assets transferred. - De-Identified or Aggregated Data. We may share your Personal Data on an aggregated basis for any purpose in which your specific information is blinded, masked, or otherwise not identifiable.
- With Your Consent. We may disclose Personal Data consistent with this Privacy Policy with your consent.
C. Sale of Your Personal Data
For purposes of this Privacy Policy, “sale of Personal Data” means the exchange of Personal Data for monetary consideration but does not include, for example, the disclosure and/or transfer of Personal Data to a third party for processing on behalf of Company or in furtherance of providing Services requested by a consumer; the disclosure and/or transfer of information intentionally made public by a consumer or to a third party as directly requested by a consumer; or the disclosure and/or transfer of Personal Data as an asset that is part of a merger, acquisition, bankruptcy, or other transaction in which a third party assumes control of all or part of Company’s assets.
We do not disclose Personal Data to third parties in exchange for monetary compensation.
D. Use and Disclosure of Sensitive Data
We do not collect, use, or disclose Sensitive Data beyond the purposes authorized by the applicable law. Accordingly, we only use and disclose Sensitive Data reasonably necessary and proportionate to: (i) perform our Services requested by you; (ii) help ensure security and integrity, including to prevent, detect, and investigate security incidents; (iii) detect, prevent and respond to malicious, fraudulent, deceptive, or illegal conduct; (iv) verify or maintain the quality and safety of our services; (v) comply with our legal obligations; (vi) coordinate with our service providers in their performances of services on our behalf; and (vii) to further related purposes, other than inferring characteristics about you.

III. Information Security
We use reasonable and appropriate administrative, physical, and technical security measures designed to protect your Personal Data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. In addition, we have implemented internal policies and procedures to restrict access to your Personal Data, ensuring that only employees who require the information to perform their specific job responsibilities are granted access. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of Personal Data transmitted over the Internet or stored or maintained by us or our third-party service providers. IV. Data Retention
We retain your Personal Data for as long as reasonably necessary, to fulfill the purposes described in this Privacy Policy (or as otherwise legally permitted or required), including fulfilling and maintaining our Services, operating the Company, complying with our legal obligations, resolving disputes, enforcing our policies, and furthering safety, security, and fraud prevention. V. Your Choices
A. Marketing Communications. If you do not want to receive marketing and promotional emails from us, you may click on the “unsubscribe” link in the email sent to you or see Contact Us below for more information.
B. Text Messages. You may opt in to receive text messages from Company or third-party service providers on Company’s behalf. By opting in to receive text messages, you agree that you have provided Company and/or its third-party service providers prior express written consent to be contacted by text message, including recurring automated promotional and personalized marketing text messages.
- By providing prior express written consent, you agree to receive text messages under the Telephone Consumer Protection Act and related state laws, including by the use of an automatic telephone dialing system (“ATDS”), to deliver text messages to the mobile phone number provided to Company. While you consent to receive messages sent using an ATDS (or “autodialer”), the foregoing shall not be interpreted to suggest or imply that any or all of Company mobile messages are sent using an autodialer. We will use the Personal Data provided by you in connection with text messaging services in accordance with this Privacy Policy. Your consent is not a condition of any purchase or use of our Services, and your consent, as described, is voluntary. The number of text messages you receive may vary, based on selected text messaging service(s). Message and data rates may apply.

VI. Notice to Certain Residents of Data Subject Rights

- Right to Request Deletion. You may have the right to request that we delete certain Personal Data collected about or provided to us by you, subject to any legal exceptions and limitations and/or as permitted under applicable law.
- Right to Request Correction of Inaccurate Personal Data. To the extent we may maintain inaccurate information, including Personal Data, you may have the right to request that we correct such inaccuracies, considering the nature of the Personal Data, the purposes of its processing, and applicability or limitations under applicable law.
- Right to Object/Restrict. You may have the right to object to or request restrictions on how we process your Personal Data, subject to any legal exceptions and limitations and/or as permitted under applicable law.
- Right to Withdraw Consent. Where we rely on your consent, you may have the right to withdraw it at any time, subject to any legal exceptions and limitations and/or as permitted under applicable law.
- Right to Opt Out of the Sale and Sharing of Personal Data. You may have the right to opt out of the processing of your Personal Data for the purpose of selling or sharing of your information for cross-context behavioral advertising. As noted in this Privacy Policy, we do not sell your Personal Data. - Right to Limit Use and Disclosure of Sensitive Data. - Right to Non-Discrimination. You may have the right to not be discriminated against for exercising your rights, either in the provision of our Services or quality of our Services you receive. Discrimination may include, but is not limited to, denying Services, charging different prices or rates for Services, or providing a different level of quality of Services.
- Right to Appeal. You may have the right to appeal our denial of any request you make under this section. To exercise your right to appeal, please submit an appeal request to us, using the information provided in the Contact Us section below. Within the certain timeframe of receipt of your appeal, as proscribed by applicable law, we will inform you in writing of any action taken or not taken in response to your appeal, including a written explanation of the reasons for the decisions. If we deny your appeal, you may contact the Attorney General or another authority, which we will help you identify.

VII. Exercising Your Data Privacy Rights
To exercise any of the rights described above, please submit an authenticated consumer request to us via the methods described below. The authenticated consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data and entitled to exercise the consumer rights listed in Section VI above; and
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to the request.
To help protect your privacy and maintain security, if you request access to or deletion of your Personal Data, we will take steps and may require you to provide certain information to verify your identity before granting you access to your Personal Data or complying with your request. In addition, if you ask us to provide you with specific pieces of Personal Data, we may require you to sign a declaration under penalty of perjury that you are the consumer whose Personal Data is the subject of the request.
If permitted by the applicable data protection law, you may use an authorized agent to submit requests on your behalf provided that the authorized agent is a natural person or a business entity that you have authorized to act on your behalf. If you use an authorized agent, we will require: (1) proof of written permission for the authorized agent to make requests on your behalf, and identity verification from you; or (2) proof of power of attorney pursuant under applicable law. Only you or your authorized agent may submit an authenticated consumer request related to your Personal Data. We may deny a request from an authorized agent that does not submit proper verification proof. You may also submit an authenticated consumer request on behalf of your minor child.
We aim to respond within the timeframe required by law. If more time is needed, we will notify you in writing with the reason and extension period. We do not charge fees unless requests are excessive or repetitive. If a fee applies, we will provide a cost estimate before proceeding.

VIII. Geographic Location of Data Storage and Processing
Our Services are targeted to individuals located inside the United States, and we maintain all operations in the United States. As such, our Services collect Personal Data and process and store that information in databases located in the United States. If you are visiting our Services from outside the United States, you should be aware that you may transfer your Personal Data to the United States, and the data protection laws of the United States may not be as comprehensive as those in your own country. By visiting our Services and submitting any Personal Data, you consent to the transfer of such information to the United States.

IX. Children's Personal Data
In compliance with the Children’s Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501-6506 and 16 C.F.R. §§ 312.1-312.12, we do not permit children under thirteen (13) years of age to register for or use our Services. By using our Services, you represent that you are thirteen (13) years of age or older.
Additionally, we do not knowingly collect any Personal Data from children under the age of eighteen (18). If we learn that a user under eighteen (18) years of age has provided us with Personal Data, without verified parental consent, we will take steps to comply with applicable legal requirement to remove such Personal Data.
